Terms and Conditions

Welcome to the AnnSetu Cold Storage Dashboard (the "Platform"), operated by PN Annsetu Network Private Limited ("AnnSetu", "we", "us", or "our"). By registering for, logging into, or accessing our dashboard services, you ("User", "Operator", or "Customer") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you must immediately cease using the Platform. These Terms constitute a legally binding agreement between you and AnnSetu, governing your access and usage of the warehouse stock, ledger billing, and onboarding management systems.

To access the platform, you must register a Cold Storage Facility account. You represent and warrant that: • All registration information you submit is truthful and accurate. • You are responsible for safeguarding your credentials (passwords, OTP keys) and all actions performed under your account. • You must notify us immediately of any unauthorized access or breach of security. • Portal sessions automatically expire after 30 minutes of inactivity to protect stored records.

Under the Digital Personal Data Protection (DPDP) Act, 2023, the Cold Storage Operator acts as a "Data Fiduciary" for the personal data of farmers and vendors onboarded onto the platform. • Consent Verification: Before entering any personal data (Name, Father's Name, Phone, Aadhaar, PAN, Bank Accounts) of a Farmer or Vendor, you MUST obtain explicit, verifiable, informed, and unambiguous consent from that individual. • Notice Presentation: You must present the localized DPDP Notice outlining why their data is processed (lot management, interest calculation, SMS updates) and verify they have checked the consent declaration. • Grievance Record: You must log and track consent records in accordance with platform configurations.

The Platform is provided to manage cold storage warehouse lots. • Accuracy: Operators are solely responsible for verifying the accuracy of inbound potato/commodity packet volumes, weights, and grade assessments during Amad lot creation. • Transference: Any Sauda (sales) commitments and Nikasi (dispatch dispatches) recorded on the platform must represent authentic physical transactions. • Liability: AnnSetu acts solely as a technical service provider and Data Processor. We are not a party to commercial transactions between operators, farmers, and vendors.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW: • "As Is" Warranty: The Platform is provided on an "as is" and "as available" basis without warranties of any kind. • Operational Risks: AnnSetu is not liable for physical commodity spoilage, weight loss due to dehydration, cold chamber mechanical failure, power fluctuations, or market price changes of agricultural commodities. • Cap on Liability: In no event shall AnnSetu's aggregate liability exceed the subscription fees paid by you to us in the three (3) months preceding the claim.

We reserve the right to suspend or terminate your portal access at our sole discretion, without notice, if: • You violate these Terms or applicable local laws (including the IT Act 2000 and the DPDP Act 2023). • You upload fraudulent transaction records, non-consensual personal files, or attempt to bypass cryptographic field safeguards. • You fail to pay subscription invoices in a timely manner.

These Terms shall be governed by and construed in accordance with the laws of India. • Jurisdiction: Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts in India. • Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force. • Support Contact: For query resolution, contact our technical support at support@annsetu.in.
